Brand Privacy Statement

1. Who We Are and Scope of This Statement

This Privacy Statement is made by Whiskey JYPSI (the "Brand," "we," "us," or "our") and describes how we collect, use, disclose, and protect personal information in connection with whiskeyjypsi.com (the "Site"), our email and SMS communications, and other Brand-operated channels (together, the "Brand Services").

For purposes of this Statement, "Whiskey JYPSI" means the Whiskey JYPSI brand and any entity that owns or operates the Brand from time to time, including any successor, assign, parent, subsidiary, or affiliate that acquires ownership or operation of the Brand, regardless of that entity's legal name or corporate structure. The commitments in this Statement attach to the Brand and continue to apply to your personal information notwithstanding any change in the Brand's corporate ownership, legal entity name, or organizational structure. See Section 8 (Brand Continuity and Changes in Ownership).

Purchases are handled separately. Purchases made on the Site are completed through a checkout experience operated by Flaviar, Inc. and fulfilled by licensed independent third-party retailers. Information you provide during checkout (such as payment details and shipping address) is collected and processed by Flaviar under its own privacy policy, available at https://www.whiskeyjypsi.com/policies/privacy-policy. This Statement does not govern Flaviar's or any retailer's handling of your information. Where Flaviar provides the Brand with information about your purchases, we handle that information under this Statement.

2. Age Restriction

The Brand Services are intended only for individuals of legal drinking age (21 years or older in the United States). We do not knowingly collect personal information from anyone under the legal drinking age, and we do not knowingly sell or share the personal information of anyone under 16 years of age. If we learn we have collected personal information from someone under the legal drinking age, we will delete it.

3. Information We Collect

Information you provide to us:

  • Contact details, such as name, email address, phone number, and ZIP code, when you sign up for our email or SMS list, create an account, enter a promotion, or contact us;
  • Date of birth or age confirmation, for age verification;
  • Communications you send us, such as customer service inquiries and survey responses; and
  • Content you submit through Brand programs (for example, community or ambassador programs), where applicable.

Information collected automatically: When you use the Site, we and our service providers may collect information through cookies and similar technologies, including IP address, device and browser information, pages visited, links clicked, and the site you came from. 

Information from other sources: We may receive information about you from service providers acting on our behalf and from Flaviar in connection with purchases you make through the Site's checkout (such as order confirmations and purchase history), which we use as described in this Statement.

4. How We Use Information

We use personal information to:

  • Provide, operate, and improve the Brand Services;
  • Send you marketing communications you have signed up for, subject to Section 7 (Marketing Consent Is Brand-Specific);
  • Send transactional and administrative messages;
  • Verify age and eligibility;
  • Personalize content and offers;
  • Conduct analytics, research, and development;
  • Protect against fraud, misuse, and unlawful activity; and
  • Comply with legal obligations and enforce our rights.

5. How We Disclose Information

We disclose personal information only as follows:

  • Service providers: to companies that perform services on our behalf, such as website hosting, email and SMS delivery, analytics, customer service, and security. These providers are permitted to use your information only to provide services to the Brand.
  • Flaviar and retailers: as needed to facilitate purchases you initiate through the Site's checkout, as described in Section 1.
  • Legal: where required by law, subpoena, or court order, or where we believe disclosure is necessary to protect the rights, property, or safety of the Brand, our customers, or others.
  • Corporate transactions: solely as described in Section 8, and subject to the protections in that section.

We do not sell your personal information for money. 

6. Your Rights and Choices

Depending on where you live, you may have the right to request access to, correction of, or deletion of your personal information, and to opt out of certain processing. To exercise these rights, contact us at info@whiskeyjypsi.com. We will verify your request and respond as required by applicable law. You will not be discriminated against for exercising your rights.

You can unsubscribe from marketing emails at any time using the link in any marketing email, and from SMS by replying STOP. You can manage cookies through the Site's cookie settings.

7. Marketing Consent Is Brand-Specific

When you sign up to receive communications from Whiskey JYPSI, you consent to receive marketing communications from the Whiskey JYPSI brand and from other brands within our family of brands, including brands owned by our current or future parent or affiliated companies. Communications from other brands in our family will identify the sending brand and its relationship to Whiskey JYPSI. You can unsubscribe from any brand's communications at any time using the link in any email, by replying STOP to any SMS, or by contacting us at info@whiskeyjypsi.com and unsubscribing from one brand does not affect your subscriptions with others unless you request it.

8. Brand Continuity and Changes in Ownership

The Brand may in the future be part of a corporate transaction, such as a renaming, reorganization, merger, acquisition, or sale of the Brand or its assets. If that happens:

  • Your personal information will remain subject to this Privacy Statement, or to a successor statement that provides protections at least as protective as this one;
  • Any successor entity that acquires ownership or operation of the Brand assumes the commitments in this Statement with respect to personal information collected under it;
  • Your marketing consent transfers at the scope described in Section 7 consent carries forward to the successor's family of brands, subject to your unsubscribe rights and
  • If a successor proposes to materially change how your personal information is handled, we or the successor will notify you before the change applies to you, and where required by law, will obtain your consent.

    9. Data Retention

    We keep personal information for as long as needed for the purposes described in this Statement and as required by law, after which we delete or de-identify it.

    10. Security

    We maintain physical, technical, and administrative safeguards designed to protect personal information. No system is completely secure, and we cannot guarantee the security of your information.

    11. Changes to This Statement

    We may update this Statement from time to time. We will post updates on this page and revise the Effective Date. If we make material changes, we will provide notice as required by law. Any update remains subject to the commitments in Section 8.
